E.U. Targets Boehringer For Misuse Of Patent System

Law360, New York (March 30, 2007, 12:00 AM EDT) -- Antitrust proceedings have been initiated against German drug maker Boehringer AG and its subsidiaries for allegedly misusing the patent system to eliminate competition in the market for lung disease drugs, the European Commission announced Friday.

The proceedings, which were initiated March 22, “concern misuse of the patent system in order to exclude potential competition in the area of chronic obstructive pulmonary disease (COPD) drugs,” the Commission said.
