8th Circ. Affirms Bar On Swepco Power Plant In Ark.

Law360, New York (December 21, 2010, 1:27 PM EST) -- A federal appeals court has upheld an injunction blocking Southwestern Electric Power Co. from continuing construction on a $1.7 billion coal-fired power plant in Arkansas that has come under fire from environmental groups.

The U.S. Court of Appeals for the Eighth Circuit on Monday vacated its Nov. 24 interim judgment in favor of Swepco's bid to stay a preliminary injunction that had been granted by Judge William R. Wilson Jr. of the U.S. District Court for the Eastern District of Arkansas.
