Union Pacific Sues Shell Over Site Cleanup

Law360, New York (January 3, 2011, 1:52 PM EST) -- Union Pacific Railroad Co. has filed suit against Shell Oil Co. in an effort to force the energy giant to help pay for environmental cleanup costs at a Louisiana scrap yard.

Union Pacific contends in its suit, filed Dec. 28 in the U.S. District Court for the Western District of Louisiana, that Shell is responsible for a subsurface plume of hazardous substances at a site in Calcasieu Parish and owes response costs under both the Comprehensive Environmental Response, Compensation and Liability Act and Louisiana state law....
