Eaton's Trade Secrets Suit Nixed Over Atty Misconduct

Law360, New York (January 3, 2011, 8:07 PM EST) -- A Mississippi court has tossed a trade secrets suit brought by Eaton Corp., saying it was the only appropriate sanction when the power management company allegedly hired an attorney to try and improperly influence the case's former judge, who is now in prison.

In an opinion issued Dec. 22 and unsealed Wednesday, Hinds County Circuit Court Judge W. Swan Yerger said Eaton either knew or should have known of the ex parte contacts and improprieties made by attorney Ed Peters with his close friend, ex-Judge Bobby B....
