False Marking Suit Survives Ranbaxy's Dismissal Bid

Law360, New York (January 4, 2011, 4:45 PM EST) -- A federal judge has rejected Ranbaxy Laboratories Inc.'s motion to throw out a retired radiologist's suit accusing the company of trying to trick the public by marking its topical anti-itch and inflammation medicine Ultravate with an expired patent.

Judge Timothy J. Savage of the U.S. District Court for the Eastern District of Pennsylvania signed off on an order filed Dec. 29 denying Ranbaxy's motion to dismiss and plaintiff Bentley Hollander's cross-motion for judgment on the pleadings.
