NRDC Suit Over Landfill Contamination Stays Alive

Law360, New York (January 4, 2011, 6:55 PM EST) -- A federal judge has again kept alive a suit from the Natural Resources Defense Council and homeowners near Dickson, Tenn., seeking to compel the city and three companies that own industrial facilities to clean up contamination from an area landfill.

Judge Todd Campbell of the U.S. District Court for the Middle District of Tennessee on Monday denied the defendants' two motions for summary judgment and partially denied the plaintiffs' motion for summary judgment, ruling that genuine issues of disputed material fact still exist.
