Portuguese Court Upholds €3M Abbott Price-Fixing Fine

Law360, New York (January 4, 2011, 5:36 PM EST) -- A Portuguese appeals court has upheld a €3 million ($4 million) fine against Abbott Laboratories Ltd. for fixing the price of blood glucose test strips sold to hospitals, but tossed a similar penalty against Johnson & Johnson.

The Lisbon Court of Appeal also reduced a €2 million fine against Italy's Menarini Diagnostics Ltd. to €1 million, ruling that the alleged price-fixing scheme constituted one offense that ran for several years rather than a series of separate offenses, the Portuguese Competition Authority said Friday.
