9th Circ. Overturns Win For Accused Korean Embezzler

Law360 (January 5, 2011, 5:55 PM EST) -- The Ninth Circuit has overturned a post-trial win for Kim Kyung-joon, a South Korean businessman and former business partner of the country's president accused of embezzling $33 million from a company he controlled.

The lower court judge presiding over Kim's trial was wrong to reverse a jury verdict finding Kim took money from Optional Capital Inc., a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit said in an order issued Tuesday.
