High Court Takes On Two Ineffective Assistance Appeals

Law360, New York (January 7, 2011, 7:42 PM EST) -- The U.S. Supreme Court agreed Friday to hear two related cases that will clarify the rights a defendant has when his attorney advises him to reject a plea agreement he would have been better off accepting.

The court said in a routine notice that it will hear two cases — Lafler v. Cooper and Missouri v. Frye — where defendants were convicted and received greater sentences than were initially offered in plea agreements.
