E.C. Will Take Spain To Court Despite E.On's Exit

Law360 (April 3, 2007, 12:00 AM EDT) -- The allegedly protectionist energy consolidation policies of Spain may have finally caused would-be suitor E.On AG to withdraw its offer for Endesa SA, but the country is still not off the hook with the European Commission.

“We shall continue our action against Spain before the court,” said Commission spokesperson Jonathan Todd.

The Commission said last week that it would take Spain to Europe’s highest court for its continuous interference in the proposed merger of E.On and Endesa.
