Apotex Sues Forest Labs Over Generic Lexapro

Law360, New York (January 11, 2011, 1:35 PM EST) -- Generic-drug maker Apotex Inc. has filed a suit seeking declaratory judgment of noninfringement against Forest Laboratories Inc. in an effort to market a generic version of blockbuster antidepressant Lexapro.

Catherine T. Dobrowitwsky of Miller Canfield Paddock & Stone PLC lodged Apotex's suit in the U.S. District Court for the Eastern District of Michigan on Monday, asking the court to find that Apotex's version of escitalopram oxalate, which Forest markets under the brand name Lexapro, would not infringe U.S. Patent Numbers 6,916,941 and 7,420,069.
