EPA Revokes Arch W.Va. Coal Mine Permit Over Waste

Law360, New York (January 13, 2011, 2:55 PM EST) -- The U.S. Environmental Protection Agency has decided to exercise a rarely used veto power to foreclose on a West Virginia mine permit for Arch Coal Inc. that would have allowed disposal of mining waste into local streams.

The decision will affect Arch Coal unit Mingo Logan Coal Co.'s Spruce No. 1 coal mine, the EPA said Thursday.

The EPA has used its authority under the Clean Water Act to issue such a veto in just 12 circumstances since 1972. The agency said it reserved the option...
