Puerto Rican Plane Fuel Antitrust Suit Tossed

Law360 (January 19, 2011, 2:30 PM EST) -- A federal judge has dismissed a charter airline company's suit alleging three fuel suppliers created an unfair monopoly in the Puerto Rican aviation gasoline market.

Judge Gustavo A. Gelpi of the U.S. District Court for the District of Puerto Rico ruled Tuesday that all three of Diaz Aviation Corp.'s claims against Airport Aviation Services Inc., Total Petroleum Puerto Rico Corp. and Esso Standard Oil Co. either cited criminal statutes that did not apply to civil claims or did not satisfy the basic elements of antitrust claims....
