Insurers Accuse Metals Co. Of Discovery Abuses

Law360, New York (January 19, 2011, 4:43 PM EST) -- Three insurers in a coverage dispute over $39 million in damages related to a transformer failure at a metals plant have accused Felman Production Inc. of severe discovery abuses and asked that the company's case be dismissed.

Industrial Risk Insurers, Westport Insurance Co. and Swiss Reinsurance America Corp. filed a motion for sanctions Tuesday in the U.S. District Court for the Southern District of West Virginia, saying Felman has made blatant misrepresentations to the court and to opposing counsel.
