Invalid Patent Correction Leads To Reversal

Law360, New York (April 5, 2007, 12:00 AM EDT) -- Citing an invalid certificate of correction from the U.S. Patent and Trademark Office, a federal appeals court has reversed a lower court ruling that a pharmacy service company willfully infringed a patent for heart-surgery chemical technology.

In a decision issued April 3, the U.S. Court of Appeals for the Federal Circuit vacated a summary judgment ruling of infringement against Advanced Cardiac Solutions PC, and asked the lower court to reconsider the charges under the patent's original, uncorrected claims.
