3rd Circ. Sends Alcoa Toxic Tort Case Down Under

Law360, New York (January 20, 2011, 6:11 PM EST) -- The Third Circuit has shot down a bid by hundreds of Australian plaintiffs to sue Alcoa Inc. in the U.S. over fatal injuries allegedly caused by emissions at three refineries in Western Australia.

In an opinion filed Thursday, the U.S. Court of Appeals for the Third Circuit found that the lower court correctly dismissed the five consolidated suits on forum non conveniens grounds, even if the allegations center on policies hatched at Alcoa’s Pittsburgh headquarters.
