7th Circ. OKs US Discovery In German Bone Cement Suit

Law360 (January 24, 2011, 6:26 PM EST) -- Bone cement maker Heraeus Kulzer GmbH will be able to force U.S.-based adversary Biomet Inc. to comply with liberal U.S. discovery rules in their trade secrets dispute playing out in Germany, the Seventh Circuit ruled Monday.

A three-judge panel of the U.S. Court of Appeals for the Seventh Circuit ruled that Heraeus can compel discovery under U.S. rules, even though its lawsuit against Biomet is taking place in Germany, where discovery is much harder to obtain.
