Fraud, Contract Claims Cut From Exxon Gas Leak Suit

Law360, New York (January 24, 2011, 7:03 PM EST) -- A federal judge Monday trimmed down a gas station owner's fraud and breach of contract suit against Exxon Mobil Corp. over a 26,000-gallon gas leak, leaving only a fraudulent concealment claim over faulty leak detection equipment.

Judge William D. Quarles Jr. of the U.S. District Court for the District of Maryland granted Exxon's motion to dismiss fraud, negligent misrepresentation, breach of contract and detrimental reliance claims arising from Exxon's alleged failure to perform a buyout agreement following the discovery of the leak, saying the claims were...
