CIT Remands Xerox Toner Cartridge Suit To Customs

Law360, New York (January 26, 2011, 6:30 PM EST) -- A federal judge has rejected the U.S. government's bid to dismiss a case brought by Xerox Corp. challenging a U.S. Customs and Border Protection ruling on toner cartridges.

Judge Gregory W. Carman of the U.S. Court of International Trade signed off on an opinion and order on Monday, denying the government's motion to dismiss and remanding the final determination that sparked the dispute back to Customs.
