IBM's Blue Gene Does Not Infringe Patents: Fed. Circ.

Law360 (January 26, 2011, 5:30 PM EST) -- The Federal Circuit on Wednesday upheld a decision clearing IBM Corp. of allegations that its Blue Gene supercomputer infringes three patents for parallel processors owned by Fifth Generation Computer Corp.

In his opinion for the U.S. Court of Appeals for the Federal Circuit, Judge Alan D. Lourie agreed with a lower court that claims in FGC’s patent concerning a root bus controller must be construed narrowly, as the node connecting a binary tree of bus controllers to a host computer.
