State AGs Slam NLRB Over Secret Ballot Suits

Law360, New York (January 27, 2011, 7:53 PM EST) -- Four Republican state attorneys general took aim at the National Labor Relations Board on Thursday, fighting back against plans to sue their states over recent union organizing ballot measures that the board claims conflict with federal law.

Alan Wilson of South Carolina, Mark Shurtleff of Utah, Tom Horne of Arizona and Marty J. Jackley of South Dakota sent a letter to the NLRB criticizing its claim that voter-approved constitutional amendments that require secret ballots for organizing unions preempt the National Labor Relations Act.
