BellSouth Allowed To Deny Credits To DPi: 4th Circ.

Law360, New York (February 7, 2011, 2:04 PM EST) -- The Fourth Circuit has rejected dPi Teleconnect LLC's bid to revive its antitrust suit accusing BellSouth Communications Inc. of denying it promotional credits for the resale of telephone services on a prepaid basis.

A three-judge panel in the U.S. Court of Appeals for the Fourth Circuit on Thursday affirmed a district court's grant of summary judgment in favor of defendants BellSouth and the North Carolina Utilities Commission, concluding there was “substantial support in the record that dPi was not entitled to promotional credits.”
