Allegheny May Face Suit Over W.Va. Plant Pollution

Law360, New York (February 7, 2011, 7:36 PM EST) -- Three environmental groups have warned Allegheny Energy Inc. that they plan to launch a Clean Water Act lawsuit over alleged discharges of arsenic and other toxic pollutants from a coal-based power plant.

The Sierra Club, the West Virginia Highlands Conservancy and the West Virginia Rivers Coalition sent a notice of intent to sue to Allegheny on Friday, saying they will sue if the company does not bring the Albright, W.Va., plant into compliance with the law within the 60-day notice period.
