NC Dental Board Not Immune From Antitrust Law: FTC

Law360, New York (February 8, 2011, 7:12 PM EST) -- The Federal Trade Commission on Tuesday refused to drop its case against North Carolina's dental board, ruling that the state-action doctrine does not protect the board from antitrust scrutiny because it is run by practicing dentists.

The FTC rejected the North Carolina State Board of Dental Examiners' motion to dismiss a complaint brought in June that accuses the board of clamping down on competition by allowing only dentists to perform teeth-whitening services in the state.
