USPTO Hands Down Guidelines To Boost Patent Quality

Law360, New York (February 9, 2011, 7:34 PM EST) -- The U.S. Patent and Trademark Office issued guidelines for patent examiners Wednesday mandating that applications distinctly claim inventions, in a move aimed at promoting patent quality and ensuring the public is aware of patent rights.

The supplementary guidelines, which address Section 112 of the U.S. Patent Act dealing with specification, say the USPTO will reject patent applications that do not distinctly claim inventions as "indefinite" if the examiner cannot resolve the issues through an interview with the applicant.
