Fed. Circ. Won't Rescue Hako-Med Patent Verdict

Law360, New York (February 11, 2011, 4:48 PM EST) -- The Federal Circuit on Friday denied Hako-Med USA Inc.'s appeal of a lower court's decision to overturn a jury verdict that found Axiom Worldwide Inc.'s electrotherapy device had infringed Hako-Med’s patent.

In a tersely-worded order, the U.S. Court of Appeals for the Federal Circuit upheld the trial court’s decision to nullify Hako-Med’s $450,000 win, ruling the plaintiff failed to provide evidence to support the jury’s infringement finding under the doctrine of equivalents.
