Fed. Circ. Won’t Reinstate Lapsed University Patent

Law360, New York (February 11, 2011, 8:14 PM EST) -- The Federal Circuit has denied a bid by the University of Minnesota regents to overrule the U.S. Patent and Trademark Office’s denial of a renewal for a lapsed cardiac technology patent.

The one-page order, delivered Friday in the U.S. Court of Appeals for the Federal Circuit, upholds an earlier order from Judge Gerald Bruce Lee of the U.S. District Court for the Eastern District of Virginia who found the university hadn’t sufficiently proven the missed renewal fee was unavoidable.
