Kellogg Says Rival Plucked Veggie Brand Design

Law360 (February 14, 2011, 7:40 PM EST) -- Kellogg NA Co. has accused a rival frozen vegetarian food maker of ripping off its Morningstar Farms brand packaging, hoping to boost its sales through association with the popular brand.

Kellogg filed a complaint in the U.S. District Court for the Western District of Michigan on Friday, accusing Foodtech International Inc. of deliberately and illegally changing its Veggie Patch packaging to closely resemble Morningstar Farms boxes.

Kellogg argues that the Veggie Patch redesign is infringing on its trade dress.
