Columbia Battles GoldToeMoretz Over Sock Design

Law360 (February 14, 2011, 3:25 PM EST) -- Columbia Sportswear Co. has sued sock maker GoldToeMoretz LLC, seeking a ruling that a design with three inverted triangles on Columbia's women's hiking socks does not mimic GoldToeMoretz's trademarked three-chevron design.

Columbia argues that the three equally-spaced inverted triangles on its socks are merely ornamental and do not serve as a trademark for the company, according to the complaint Columbia filed Friday in the U.S. District Court for the District of Oregon.

The suit comes on the heels of a Jan. 15 cease and desist letter...
