A Different Approach To Tax Strategy Patents

Law360, New York (February 25, 2011, 2:56 PM EST) -- On Feb. 3, the Senate Judiciary Committee reported out S. 23, the Patent Reform Act of 2011,[1] which proposes substantial changes to current patent law. One interesting part of the bill lies in Section 14, which would appear to effectively ban the issuance of patents claiming tax strategies.

Tax strategy inventions, as expressed in the bill, would appear to encompass all inventions claiming any strategy for reducing, avoiding or deferring tax liability. The language of the bill would seem to cover any novel method of tax...
