Chubb Loses Bid To End LymTal Coverage Fight

Law360, New York (February 15, 2011, 4:36 PM EST) -- Chubb Custom Insurance Co. has lost its bid to shut down chemical maker LymTal International Inc.'s suit accusing the insurer of improperly refusing to cover its defense costs in a personal injury dispute in Oklahoma state court.

Judge Joe Heaton denied Chubb's motion for summary judgment in the U.S. District Court for the Western District of Oklahoma on Tuesday, ruling that LymTal is entitled to discovery on its bad faith and breach of contract claims.
