Watson's Generic Mucinex Doesn't Infringe, Judge Says

Law360 (February 18, 2011, 5:07 PM EST) -- A federal judge in Florida ruled Friday that Watson Laboratories Inc.’s generic version of Mucinex has a different formulation than Reckitt Benckiser Inc.’s blockbuster expectorant and therefore does not infringe an asserted patent.

Judge William P. Dimitrouleas of the U.S. District Court for the Southern District of Florida issued his conclusions following a trial earlier in February, and moved Watson a big step closer to commercializing its generic Mucinex, which still awaits regulatory approval.
