Horse Breeder Bucks Baker Hostetler In Fee Appeal

Law360 (February 24, 2011, 8:49 PM EST) -- A Kentucky federal judge has overturned a bankruptcy court's decision in favor of Baker Hostetler in a dispute over $848,000 in attorneys' fees with the Chapter 7 trustee of thoroughbred horse breeder ClassicStar LLC.

On Tuesday, Chief Judge Jennifer B. Coffman of the U.S. District Court for the Eastern District of Kentucky reversed and remanded the bankruptcy court's decision with instructions that it complete the two-step, factual inquiry it failed to perform the first time when it ruled against Chapter 7 trustee James D.
