Massey To Create Medical Fund In W.Va. Slurry Suit

Law360, New York (February 24, 2011, 4:36 PM EST) -- Massey Energy Co. said Thursday that it would create a medical monitoring fund for hundreds of West Virginia residents who claim the company contaminated groundwater with more than 1 billion gallons of coal slurry.

The deal for the medical monitoring fund came out of a two-day mediation session that was otherwise unsuccessful in resolving the long-standing lawsuit, which is set for trial in August in the Circuit Court of Ohio County, West Virginia.
