Trial Date Set In OraSure Patent Suit Vs. Schering-Plough

Law360, New York (September 28, 2004, 12:00 AM EDT) -- A federal judge has set the trial date in OraSure Technologies' lawsuit against a Schering-Plough unit, after OraSure pulled its motion for a preliminary injunction against the sale of a rival wart-removal product.

OraSure filed suit in U.S. District Court for the Eastern District of Pennsylvania in July, accusing Schering-Plough’s Freeze Away wart remover of infringing patent rights for its Freeze-Off product.

The company asked the court to issue a preliminary injunction to halt sales of Schering-Plough's product, which is marketed under the Dr. Scholl's brand....
