Femina Hits Merck, Pharmacies With NuvaRing 337 Suit

Law360, New York (February 28, 2011, 6:37 PM EST) -- Miami-based Femina Pharma Inc. on Friday accused a group of companies including Merck & Co. Inc., CVS Caremark Corp., Walgreens Co. and Wal-Mart Stores Inc. of infringing its patent when they import Merck's NuvaRing vaginal ring birth control devices.

The complaint, lodged in the U.S. International Trade Commission, also names Merck unit N.V. Organon, which makes NuvaRing in the Netherlands, as a respondent.

The NuvaRing product infringes U.S. Patent Number 6,086,909, issued in 2000 and titled "Device and method for treatment of dysmenorrhea," the complaint says,...
