Hartford, First State Seek To Dodge MTBE Suit

Law360, New York (March 2, 2011, 3:01 PM EST) -- Hartford Accident and Indemnity Co. and First State Insurance Co. launched a suit Tuesday in Maine federal court claiming they do not owe Irving Oil Corp. coverage for litigation over methyl tertiary butyl ether contamination.

The two umbrella liability policies issued by Hartford and the four primary, excess and umbrella policies issued by First State contain pollution and other exclusions that preclude coverage, according to the insurers' declaratory judgment suit filed in the U.S. District Court for the District of Maine.
