Damage Done, Go On Mining, Judge Says

Law360, New York (April 18, 2007, 12:00 AM EDT) -- A federal court judge has given Massey Energy Co. the go-ahead to continue using valley fills at three mountain-top removal mines, altering his previous order on the grounds that the bulk of the damage has already been done.

The four Massey-owned coal mines, based in West Virginia, asked Judge Robert Chambers to suspend his previous order, which voided their permits for using the valley fills, while they appealed his decision. The miners argued that putting a stop to the work would force them to fire employees...
