Swiss Court Lifts Ban On Nespresso Rival's Coffee Pods

Law360, New York (March 4, 2011, 2:36 PM EST) -- A Swiss court on Friday lifted a temporary injunction barring Denner AG from selling single-serve coffee capsules that allegedly infringe a Nestle SA unit's patents.

The president of the Commercial Court in the Swiss canton of St. Gallen lifted the temporary injunction on the manufacturing, advertising and sale of Denner's capsules, which are compatible with Nespresso-brand coffee machines. Denner argued the capsules' shape, which Nespresso said infringed its patents, was a technical necessity for them to fit in the machines, the company said in a statement....
