Fla. Bill Would Cap Recoveries Against Insurers

Law360, New York (March 4, 2011, 4:59 PM EST) -- Two Florida Republicans introduced companion state legislation Thursday that would set limits on civil remedies individuals could seek against insurers who engage in a bad-faith failure to settle under an insurance contract.

State Rep. Dennis K. Baxley introduced HB 1187 in the Florida House of Representatives and state Sen. John Thrasher introduced SB 1592 in the Florida Senate to cap damages, limit discovery and impose certain limitations for parties making claims against insurers.

If passed, the legislation would go into effect on July 1.
