$8M Contamination Coverage Row Sent To Ohio Court

Law360, New York (March 4, 2011, 6:52 PM EST) -- An Ohio federal judge on Friday sent an $8 million food contamination coverage dispute between HoneyBaked Foods Inc. and Affiliated FM Insurance Co. to the state’s Supreme Court, saying state law and precedent were unclear on the case’s core question.

Judge James Garr of the U.S. District Court for the Northern District of Ohio said HoneyBaked’s suit to recover from Affiliated FM losses related to contaminated runs of ham and turkey products hinged on whether Ohio law encompassed the reasonable-expectations doctrine.
