High Court Throws Cold Water On Sex Trademark Suit

Law360, New York (March 7, 2011, 12:51 PM EST) -- The U.S. Supreme Court on Monday refused to rehear an appeal brought from the Sixth Circuit by a sex shop owner who was blocked from calling the store Victor's Little Secret after a trademark tussle with Victoria's Secret Stores Inc.

The decision marks a major setback to shop owner Victor Moseley, who lodged the petition for certiorari, his second before the Supreme Court, in November.

"It's kind of like the fat lady sang," Moseley told Law360 on Monday.
