Kelley Drye Wins Transfer Of Merger, Contract Suit

Law360, New York (March 7, 2011, 7:11 PM EST) -- Capital City Energy Group Inc.'s suit accusing Kelley Drye & Warren LLP of botching the acquisition and sale of a company subsidiary and not including adequate noncompete provisions in a former executive's employment agreement was moved to Ohio federal court Monday.

The suit was transferred to the U.S. District Court for the Southern District of Ohio by Kelley Drye and its Chicago corporate finance partner Timothy Lavender, who argued that the federal court had jurisdiction because the parties were citizens of different states and the plaintiffs...
