MedPointe Sues Apotex Over Allergy Treatments

Law360, New York (April 19, 2007, 12:00 AM EDT) -- MedPointe Heathcare Inc. has filed a patent infringement suit against Apotex Inc., in a move to prevent the Canadian generics maker from taking a bite out of the market for MedPointe’s anti-allergy treatments.

The suit, which was filed in Delaware on Tuesday, names Apotex Inc. and Apotex Corp. as defendants.

The suit centers on U.S. Patent Number 5,164,194, issued in November 1992 and entitled “azelastine containing medicaments.” MedPointe has owned the patent, which is slated to expire in 2011, since August 2002.
