Gemini Tries To Avoid Coverage Over Condo Windows

Law360, New York (March 9, 2011, 5:46 PM EST) -- Gemini Insurance Co. sued a window manufacturer Monday in Hawaii in an effort to avoid paying defense and other costs from litigation accusing the company of making windows for a shoddily constructed condominium complex.

J. Patrick Gallagher of Henderson Gallagher & Kane lodged the insurer's suit in the U.S. District Court for the District of Hawaii, asking the court for declaratory judgment that the four commercial general liability policies Gemini issued to Fleetwood Aluminum Products Inc. do not cover claims connected to the two pending lawsuits...
