Probation Not Enough For Ex-HealthSouth Official

Law360, New York (April 20, 2007, 12:00 AM EDT) -- An appeals court has again tossed out the sentence of the former assistant controller and chief information officer of HealthSouth Corp., ordering the district court to deliver a punishment that more appropriately fits the crime.

On Thursday, the U.S. Court of Appeals for the Eleventh Circuit vacated and remanded the sentence of probation for Kenneth K. Livesay, citing the unreasonableness of the penalty that had been imposed earlier.
