Miss. Court Backs Local Noncompete Limits

Law360, New York (March 9, 2011, 4:57 PM EST) -- A Mississippi appeals court on Tuesday found that Timber Lake Foods Inc. was entitled to prevent a former employee from working for a competitor within 250 miles of the Tupelo, Miss., meat marketer.

The Mississippi Court of Appeals concluded that the geographic scope of Timber Lake’s noncompete agreement was valid and reasonable, reversing a lower court’s determination that the terms of the covenant were unenforceable given the fact that meat brokers communicate with customers nationwide regardless of location.
