Ex-KV CEO Gets 1 Month, $1M Fine For False Drug Marks

Law360, New York (March 10, 2011, 10:48 PM EST) -- Former CEO of KV Pharmaceutical Co. Marc S. Hermelin pled guilty Thursday to misbranding drugs and was sentenced to 30 days in prison and fined $1 million.

Judge E. Richard Webber also ordered Hermelin to forfeit $900,000 at a plea hearing in the U.S. District Court for the Eastern District of Missouri, prosecutors announced.

Hermelin was accused of sending out at least two oversized morphine sulfate tablets to pharmacies in California and Canada that weighed more than double the normal amount and contained more morphine yet...
