2nd Circ. Nixes Insurer’s Appeal Of Spill Coverage

Law360, New York (March 14, 2011, 3:43 PM EDT) -- The Second Circuit on Monday dismissed a pollution insurer’s appeal for lack of jurisdiction in a dispute over coverage for a $130 million American Commercial Lines Inc. oil spill.

The U.S. Court of Appeals for the Second Circuit shot down Water Quality Insurance Syndicate’s challenge of a district court’s March 2010 ruling in favor of American that determined the scope of the insurer’s obligation to reimburse American for costs related to claims arising from the company’s July 2008 barge accident along the Mississippi River.
