W.Va. DEP Seeks Sanctions On Pesticide Plaintiffs

Law360, New York (March 15, 2011, 2:08 PM EDT) -- West Virginia's Department of Environmental Protection moved Monday to quash subpoenas against its secretary and an employee, saying the plaintiffs in a suit against Bayer CropScience LP should be sanctioned for ignoring repeated warnings that they were targeting the wrong DEP members.

The DEP asked to substitute a different employee as a witness for an upcoming hearing and said the plaintiffs should pay its attorneys' fees relating to the subpoena and the its efforts to fight it, according to the motion to quash in the U.S....
